PROFESSIONAL LIABILITY INSURANCE

CHRISTIAN EDUCATORS ASSOCIATION INTERNATIONAL provides professional liability for its members who are educators. No longer will CEAI members have to depend solely upon local districts or the NEA/AFT for professional liability insurance. CEAI is a member of THE TRUST FOR INSURING EDUCATORS (TIE), composed of 59 educational associations representing 1.5 million educators. Several of the associations are:

If a member is faced with a lawsuit arising out of their professional duties, they have $1 million available to help pay any settlement, defense costs and more importantly, protect their hard-earned assets.
With the Educator's Professional Liability Policy, members are protected against a broad range of exposures. Educational related lawsuits may involve allegations such as failure to educate, violation of student civil rights or improper placement of students. Members are protected against these exposures - and more - whether one is at fault or completely innocent. (Exemption: a criminal charge is brought against you and you are found guilty) Policy, Forms and Endorsements

WHO'S ELIGIBLE?

Regular coverage - any member of ours who is a W-2 employee of an educational entity; i.e., school, university, or college. This must be your main occupation. Owners and board members are not eligible for coverage.

Only registered nurses, licensed school psychologists and physical therapists, performing medically related teaching or services in the normal course of their duties as an employee of a school, are eligible for coverage of medically related teaching or services.

If you are an educator in private practice or an independent contractor, you are not eligible for this plan, but we now have a plan for you which you may qualify... Private Practice Insurance.


JOB ACTION PROTECTION:

INCLUDES JOB ACTION BENEFITS! If you are threatened with termination, suspension, reassignment or demotion, the plan will pay up to $250 for your initial consultation with an attorney and up to $750 of the cost of having an attorney represent you at a formal hearing of a school board or other authority. If you decide to sue because of termination, suspension, reassignment or demotion, you'll receive up to $750 for legal fees, subject to a $100 deductible.


Up to $4,000 for an attorney's services is included if the insured files suit following a formal hearing that results in the insured's termination, demotion, involuntary transfer, suspension or other disciplinary action, provided, however, that final judgement is rendered in favor of the insuraed. However, the Company will pay a maximum of $750 for reimbursement of attorney's fees without regard to final judgement. The first $100 of such legal fees shall be paid by the Insured before payment by the Company

PLUS YOU RECEIVE THESE INCREASED BENEFITS:

$1,000,000 and $2,000,000 POLICY (Annual Maximum)
$35.000 (After a $100 deductible, the plan pays 90 percent of your attorney's fees if you are accused of the following provided you are found not guilty or the charges are dismissed.

  • Corporal Punishment $10,000
  • Sexual Abuse $35,000

ADDITIONAL PROTECTION IS FOR CORPORAL PUNISHMENT/ACCUSATIONS OF SEXUAL ABUSE IS AVAILABLE THROUGH PRE-PAID LEGAL SERVICES.

2. Part-time Educational Employment Insurance Available to CEAI Members

If you want to add part-time educational employment to your upgraded policy, the total fee if $75 per year for the $1,000,000 policy and $103 for the $2,000,000 policy ($65 or $90 in the states of CT, ID, IL,KS,NJ, MA, ME, MO, MT.WV). Part-time educational employment includes those activities outside the normal employment as an educator such as math tutor or part-time college instructor.

3. Private Practice Insurance for CEAI Members

As a private practice professional in the education field, you are unique. Mention the words "private practice,' and most people think of doctors and lawyers. Yet since the mid 1980's more and more professionals in the education field have chosen to go the "private practice" route.

The Private Practice Liability Plan covers you from liability arising out of those professional education activities for which you've received formal specialized training. This plan protects you from damages resulting from such claims as well as defense costs, legal fees, charges and expenses.

"What is Professional Liability?"
Professional Liability is incurred when certain standards of performance are not lived up to or when services rendered by individuals with specialized training or experience in a particular area, and the person for whom service is rendered has been damaged in some way. Here's an easily cited education example: A teacher or counselor misinterprets the results of a standardized test. As the result of the misinterpretation, he/she counsels the student to take a course of study not really appropriate to the student's needs.

"Why is Professional Liability coverage so important to me as an educator?"
Educators probably don't have vast stock and bond portfolios. Personal assets (cars, homes, vacation spots) as well as other assets have come through long years of savings and hard work.An educator's Professional Liability policy can act as a safeguard to protect an individual educator's assets in the event he or she is sued as a result of an event arising out of educational duties.

"Won't my school provide Professional Liability coverage?"
Although schools in which you are employed should have adequate liability coverage, that may not always be the case. The wrong time to find out about the inadequacy is at the time the suit is filed, naming YOU as the defendant.The educator's Professional Liability Program has protected many people in professional liability suits. In the majority of these instances, the claims were not covered by the school district's insurance.And the educator's Professional Liability program was the only avenue of protection the educator had available.

"What are some examples of claims or judgments?"

  1. Child injured during gym class - $30,000 judgment against teacher.
  2. Teacher accused of sexual molestation - acquitted on all charges - $13,000 in lawyer's fees.
  3. Student injured on field trip, teacher sued for negligent supervision - $42,000.
  4. Administration sued for improperly terminating teacher - $860,000.

"Are Professional Liability plans easy to acquire?"
No. Educator's Professional Liability coverage's are only available through two means:

  1. If you belong to an education association, that association may provide you with, as a membership benefit, some form of Professional Liability insurance.
  2. Other organizations sponsor Professional Liability insurance which you may participate in at your option.

"Professional Liability plans must be expensive. Are they?"
Not necessarily. If you're a medical doctor, you could pay as much as $80,000 to $100,000 a year for liability coverage. As a member of CEAI you receive $1,000,000 liability coverage with your basic membership. For an additional $30 a year you can upgrade your coverage to $2,000,000. These policies cover your duties as an employed educator/support staff.
