Objection & Challenge
to NEA/CTA/Local Fee Calculations DATE: September 5, 2001
Dear Non-Union Teachers:
Pursuant to SB 1960 or the collective bargaining agreement, your
employer will begin seizing $600.00 or more of your wages to give
to the NEA, CTA and your local association. However, there is a way
for you to get around $250.00 of your money back! Naturally you may
want to share this letter with your colleagues.
However, if any of
them are union members, they will need to resign, since CTA does
not allow members to receive this rebate. As part of the class
action settlement in Apple v CTA, the union must immediately honor
all resignation
requests. Please have them contact me or our website at http://www.nrtw.org/rctunctaa.htm concerning
resignation procedures, letters and related items.
If you are NOT a member of the union but are
required to pay "agency
shop" fees to the NEA/CTA/local, you may request an "early" rebate
of the fees that the unions spend on political, ideological and other
noncollective bargaining activities. If you request your rebate "early," you
will receive your rebate check around October 31 -- six weeks earlier
than you would under CTA's regular "Hudson" procedure,
which is explained in its October 15 "Hudson" notice that
you will receive.
Accordingly, if you are not a member of the
union, you should immediately write Stephanie Minkin, CTA Membership
Accounting Department, P.O.
Box 4178, Burlingame, CA 94011-4178. In addition to stating your
name, home address, social security number, school district and local
association, your letter should ALSO indicate:
You object to,
and are requesting an "early" rebate of, the amount
of your fee spent for nonrepresentative activities;
You expect to
receive your rebate check before October 31, 2001;
You also
request "arbitration" because
you challenge the NEA's CTA's and local association's calculations
of their chargeable amounts:
Since you are challenging all three
calculations, including your local association', you expect
to receive immediate notification of the dates and location of
the "arbitration" hearing.
(You do not need to attend the "arbitration" or do
anything else about it. However, if you do not request "arbitration," you
will not receive any additional rebates the "arbitrator " may
order.)
Enclosed for your convenience is a letter you may complete and
use to request your rebate. Finally, send me a copy of your rebate
request
letter for my records. If you have any questions or comments,

P.S. Feel free to make copies of my letter and the enclosed rebate
request form and distribute them to your nonunion teacher colleagues
at schools.
